By accessing or using WAStack.in, our REST APIs, dashboard, and webhook services (collectively the "Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you do not agree with any of these terms, you are prohibited from using or accessing the Service. The materials contained in this website are protected by applicable copyright and trademark law.

WAStack.in provides developer tools and infrastructure to sync and automate an existing WhatsApp account. By scanning a QR code generated on our platform, you pair your WhatsApp session with our system, allowing you to send and receive messages, media, and coordinate automation via REST APIs and webhooks.

Our Service is offered on both free and paid subscription levels. The features, rate limits, and usage quotas of each plan are defined on our Pricing page and are subject to change.

IMPORTANT: WAStack.in is an INDEPENDENT service. We are NOT associated, affiliated, endorsed, sponsored, or in any way officially connected with WhatsApp Inc., Meta Platforms Inc., or any of their subsidiaries.

RISK OF ACCOUNT BANS: WhatsApp enforces strict policies against spam, bulk messaging, and unauthorized automated accounts. By using this Service, you acknowledge that automating a WhatsApp account carries an inherent risk of having that account temporarily or permanently suspended or banned by Meta/WhatsApp.

WAStack acts solely as a technical relay and proxy. We hold ZERO liability or responsibility for any account bans, session terminations, losses of chat history, or business interruptions resulting from WhatsApp/Meta taking action against your WhatsApp number.

PROTOCOL COMPATIBILITY: The Service relies on the web-based protocol of WhatsApp. Meta frequently updates their WhatsApp software, which may cause temporary disruptions or permanent changes in how our Service connects. We do not guarantee uninterrupted compatibility with WhatsApp and are not liable for downtime caused by upstream protocol changes.

You represent and warrant that you will only send messages to recipients who have explicitly consented (opted-in) to receive communications from you on WhatsApp.

You are strictly prohibited from using the Service to send spam, broadcast bulk marketing messages to non-opted-in users, distribute phishing links, transmit malware, or deliver harassing, abusive, or illegal content.

You agree to respect local quiet hours and regulations regarding marketing, and include a clear, functional opt-out (unsubscribe) mechanism in your automated interactions.

You are solely responsible for maintaining the security of your WAStack account credentials and REST API keys. Any requests made using your API keys will be deemed authorized by you.

Free Trial: New accounts receive a 3-day free trial limited to 10 messages. No payment method is required to start the trial. The trial expires automatically after 3 days or upon reaching the 10-message limit, whichever occurs first.

Non-Refundable Charges: Trial usage, overage charges, and charges for services already rendered are generally non-refundable.

WAStack.in and its original content, features, and functionality remain the exclusive property of WAStack.in and its licensors. You may not copy, modify, distribute, or reverse engineer any part of our codebase, designs, or systems.

You retain ownership of all data, text, templates, and media payloads you transmit through the Service. You grant us a temporary, non-exclusive license to process, route, and cache this content solely to perform the services requested by your application.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

IN NO EVENT SHALL WASTACK.IN, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, WHATSAPP ACCOUNT SUSPENSIONS, BANS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE.

We reserve the right to suspend or terminate your account and API access immediately, without prior notice or liability, if we determine, in our sole discretion, that you have violated these Terms, engaged in spamming, triggered excessive WhatsApp block rates, or compromised platform security.

Upon termination, your right to use the Service will cease immediately, and all authentication session keys will be purged from our active databases.

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
